Terms of Service

These terms cover your use of the SailTac software and this website. They are written to be read, not to be impressive. If something here isn't clear, email scott@sailtacperformance.com and ask.
1. What you're buying
A SailTac subscription is an annual, per-boat license to use the SailTac software. One subscription covers every device used aboard that boat by that boat's crew. It is not a per-person license, and it is not a license to operate a fleet of boats — that's what the Custom tier is for.
You are licensed to use the software, not sold ownership of it. You may not resell, sublicense, or redistribute it, or attempt to defeat its licensing.
2. License keys
- Keys are issued against the boat name you give at checkout and are valid until the expiry date they carry.
- After expiry the software continues to work for 14 days with a warning, then stops. We do this deliberately so a lapsed subscription can never strand you mid-season.
- A renewal issues a fresh key, which we email to you. You enter it once.
- If you cancel, your existing key keeps working until the date it expires. We do not remotely disable software you have already paid for.
- Keys are for your boat. Sharing a key outside your own crew is a breach of these terms.
3. Billing, renewals and refunds
- Subscriptions are billed annually in advance through Stripe. Prices are in US dollars. Any sales tax or VAT that applies where you are is calculated by Stripe and added at checkout — the total you approve on the payment page is the total you pay.
- Subscriptions renew automatically until you cancel. You can cancel any time from the billing portal linked on the account page, or by emailing us.
- Refunds:if SailTac isn't working out, email us within 30 days of a charge and we'll refund it. After that, we won't refund a term already underway, but you can cancel so it doesn't renew.
- Season-proof:if you subscribe in the spring and your season doesn't happen — the boat doesn't launch, the racing gets canceled — tell us and we'll make the next year right.
- Nothing here reduces any statutory right you have as a consumer where you live, including any legal right to cancel a digital purchase. Where our policy is more generous than the law requires, our policy applies.
4. Trials
Trial keys give full functionality for 30 days at no cost and require no payment details. One trial per email address. Trials are provided as a courtesy and we may decline or revoke one that is obviously being abused.
5. Your data
SailTac runs on your own computer. Your instrument data, race logs, polars, crew records and route plans are stored on your machine and are yours. We do not collect them, and we have no ability to read them. See the privacy policy for what we do hold.
6. Safety — read this one
SailTac is a performance and tactical tool. It is not a navigation safety system and must not be used as your primary means of navigation. It is not type-approved, not certified for safety of life at sea, and its charts, routing and forecasts can be wrong, stale or unavailable.
Weather routing is a suggestion computed from third-party forecast models and your own polar. It does not know about traffic, racing rules, exclusion zones, ice, shoal water, or the state of your boat and crew. Land avoidance is limited to the areas we have shoreline data for and is not a substitute for a chart.
You remain wholly responsible for the safe navigation of your vessel, for keeping a proper lookout, and for carrying and using appropriate charts and safety equipment. The skipper's judgement overrides anything on the screen, always.
7. Availability and third-party data
SailTac fetches forecasts and chart tiles from third-party public services when you ask it to. Those services can change, rate-limit or withdraw access, and we can't guarantee their accuracy or availability. The software is designed to keep working offline with what it has already cached.
8. Warranty and liability
The software is provided “as is”, without warranties of any kind, express or implied, including fitness for a particular purpose. We do not warrant that it will be uninterrupted or error-free.
To the fullest extent permitted by law, our total liability arising out of or relating to SailTac is limited to the amount you paid us in the twelve months before the claim. We are not liable for indirect, incidental or consequential losses — including lost races, lost placings, damage to a vessel, or any loss arising from reliance on routing, forecasts or analytics.
Nothing in these terms excludes liability that cannot lawfully be excluded, including for death or personal injury caused by negligence.
9. Ending the agreement
You can stop using SailTac at any time, and cancel from the billing portal so it doesn't renew. Your key keeps working until it expires.
We may suspend or end your license if you breach these terms in a serious way — sharing keys beyond your own crew, reselling the software, or attempting to defeat its licensing. Where the breach can be put right, we'll tell you and give you a fair chance to do so first. If we end your license for reasons that aren't your fault, we'll refund the unused part of your term.
10. Governing law
These terms are governed by the laws of the State of Michigan, United States, and disputes will be heard in the state and federal courts located in Michigan — except that if you are a consumer, you keep the right to bring proceedings where you live and to the protection of the mandatory consumer laws that apply there.
Before anyone goes near a court, please email us. Nearly everything is faster to fix that way.
11. Changes
We may update these terms. If a change materially affects you we'll email subscribers before it takes effect. Continuing to use SailTac after that means you accept the updated terms.
